These terms and conditions (the “Terms and Conditions”) govern the use of kndaconsulting.com (the “Site”). This Site is owned and operated by Kelly Adams. This Site is a nutrition consulting company.

 

The terms “we,” “us,” and “our” refer to KNDA Consulting LLC. “You” refers to any person accessing and/or using this Site. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

You understand that the Site undergoes frequent changes. We may require that you accept or use updates to the Site in order to continue using the Site. You acknowledge and agree that we may update the Site without notifying you.

 

Intellectual Property and Authorized Use

All content published and made available on our Site is the property of Kelly Adams and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of the Site. We authorize you to view and download the information and other materials at or through this Site only for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices contained in the original materials on any copies of the materials you make.

 

Sale of Services

These terms and Conditions govern the sale of services available on our Site:

 

  • Nutrition coaching and counseling

  • Meal planning

 

The services will be paid for in full when the services are ordered.

 

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.

 

We reserve the right to modify, reject, or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Scheduling & Cancellation Policy

You are required to schedule your own appointments via the scheduling link provided. You may reschedule your appointment up to 8 hours prior to your appointment at no additional cost.

If you are more than ten (10) minutes late to your scheduled session you are not eligible for a refund and will forgo that session .

Session Packages

Silver, Gold, and Platinum Packages are valid for 4 months after purchase date. You will not be eligible for a refund on any unused sessions after the 4 month period.

Orangetheory Transformation Challenge Exclusive Package is only valid from 1/13/25 through 3/10/25. You will not be eligible for a refund on any unused sessions after the 8 week period during this challenge.

Meal Plans

Meal plans are not intended to diagnose, treat, cure, or prevent any disease.

Standard, Vegetarian, and Vegan diet 1 week meal plans are not eligible for customizations.

Once a Custom 1 Week Meal Plan has been created you may not request a revision. You must purchase a session package to be eligible to purchase a Custom Meal Plan add-on. Custom Meal plans will be completed 1 week from purchase date.

Meal Plans are not eligible for a refund.

Transformation Challenge Resources

Transformation Challenge Resources including Nutrition Handout, Nutrition for Fat Loss, and Nutrition for Muscle Growth are final sale and are not eligible for a refund.

Pricing

Prices for products are subject to change without notice. All prices for products are in US dollars.

Payments

We accept the following payment methods on our Site:

  • Credit card

  • Debit

  • PayPal

 

All payments made through the Site are processed using a third-party processor. You acknowledge that KNDA Consulting LLC is not liable for any breaches of credit card or debit card security or privacy by such third-party processor. You agree to pay all charges from KNDA Consulting LLC incurred by users of your credit card, debit card, or other method of payment.

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities of Products purchased per person, per household or per order. These restrictions may include orders placed by or under the same account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you using the email address, billing address and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using these sites.

 

Limitation of Liability

Kelly Adams will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site. Except where prohibited by law, by using this Site you indemnify and hold harmless Kelly Adams from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions. Individual results may vary and results are not guaranteed.

 

Severability

If at any time any of the provisions set for in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

 

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
